Terms and Conditions of Use

Demonstration mode. Hammerprice currently runs as a live beta on the test network (Solana devnet), as a demonstration within a hackathon. Tokens and balances on the test network have no value. No payments with real money are executed and no real cards change hands. A launch on the main network is planned after the hackathon but is not promised.
Summary (without legal effect of its own)
- Hammerprice brings buyers and sellers together. We are neither seller nor buyer, nor custodian, nor payment service provider.
- Bidding is done with signed messages. A bid costs nothing but is binding.
- Payment and transfer happen in one blockchain transaction that buyer and seller both sign. We never hold your money, your card or a key that could move them. In a chance pack (section 22) you pay the pack operator first and directly and the operator delivers the card in a second transaction; we never receive that payment, and so we cannot refund it if the operator does not deliver.
- Buyers pay us no fee. Sellers pay 2.5% of the hammer price, only if the lot sells.
- Crypto-assets are risky. Read the Risk notice.
- Timed auctions, room chat, AI functions (assistant and AI agent), live video and packs are optional features with their own rules (sections 18 to 22). Telegram notifications, your profile and the waiting list are covered by sections 4.3 to 4.5.
- Hammerprice currently runs as a live beta in demonstration mode on the test network: tokens and balances have no value, and a launch on the main network is planned after the hackathon but is not promised (section 17).
1. Scope and provider
1.1 These terms govern the use of the Hammerprice platform, available at the domain of this website, including all rooms, catalogues and features (together, the "Platform"). The provider is Future Webservice, owner Farshad Shadjari, c/o Autorenglück #78416

1.2 A user is anyone who visits or uses the Platform. A bidder and buyer is anyone who bids or buys on Hammerprice. A seller is anyone who lists cards for sale on Hammerprice. A consumer is any natural person who enters into a legal transaction for purposes that cannot be attributed predominantly to their commercial or self-employed professional activity (Section 13 BGB). A business is anyone acting in the exercise of their commercial or self-employed professional activity (Section 14 BGB).
1.3 Terms of users that deviate from or add to these terms do not apply, even if we do not expressly object.
1.4 Definitions: a "lot" is a card offered for sale in the form of a token (NFT) on the Solana blockchain. A "room" or "show" is a scheduled auction room in which lots are called one after another. A "paddle" is your registration to bid in one room. "USDC" is the stablecoin issued by Circle. A "wallet" is the software or device with which you manage your private keys.
2. Our role
2.1 We operate a technical platform on which users trade collectible cards that already exist as tokens on the Solana blockchain and are held in a vault by a third party (currently Collector Crypt). We only provide the opportunity to enter into contracts between users. In demonstration mode the lots are replicas created for the demonstration; no physical card stands behind them. Some features are optional and may be switched on or off by us: timed auctions, room chat, AI functions, live video and packs (sections 18 to 22) and Telegram notifications (section 4.4). A feature that is switched off is not available.
2.2 Sales contracts for lots are concluded exclusively between the seller and the buyer. We are not a contracting party, not an agent of either party, not a commission agent and not a trustee. We owe neither delivery nor payment nor warranty for lots.
2.3 At no time do we hold crypto-assets, money, cards or private keys of users, or any key with authority over them. The only signature we add to a settlement is that of our settlement authority, which pays network fees and account rent and has no authority over any asset of the buyer or the seller. Nothing moves unless buyer and seller have both signed (section 7). You pay and transfer with your own wallet. The same holds for packs (section 22): the price of a pack goes to the pack operator, not to us. Because we hold nothing we cannot refund a payment that you made to an operator. We are not supervised by the German Federal Financial Supervisory Authority (BaFin) and offer no deposit guarantee or investor compensation.
2.4 We do not decide any hammer. A lot closes by itself under the fixed rules in sections 5 and 6, and we and our staff do not influence any result at our own discretion. In demonstration mode we run house shows (section 17.3). Where we use automated house bidders ("house paddles"), they are labelled as such and bid only in house shows. Where we draw the order of the lots in a house show by a verifiable random draw, the draw changes only the order of the lots, never a bid, a price or a result. After a house show has ended, we can also run a thank-you draw: one paddle number is drawn among the people who placed a bid in that show (without house bidders and without the seller). It carries no money, no card and no other value, only a mark on its proof page, and nobody has to take part or pay for it.
2.5 We give no investment, legal or tax advice. Prices, estimates and explanations are not a recommendation.
2.6 Hammerprice is an independent project. Collector Crypt, card manufacturers, grading companies, Circle and Solana projects are third parties. We are not affiliated with them unless expressly stated otherwise, and we are not responsible for their services.
3. Requirements for use
3.1 You must be at least 18 years old and have full legal capacity.
3.2 You may not use Hammerprice if you reside or are established in a state or territory subject to comprehensive sanctions of the European Union or the United Nations, or if you or your wallet are on a sanctions list or controlled by such a person. We may block a wallet that we know to be on a sanctions list.
3.3 You need a compatible Solana wallet. You alone are responsible for the security and backup of your wallet, your seed phrase and your keys. We cannot recover lost keys.
3.4 Each person may use only one wallet that they control for bidding, and no wallets in the name of others without their knowledge. The information you give us must be true and complete.
3.5 You can open and save these terms at any time from the footer and from the room. By using the Platform, in particular by signing in with your wallet, you agree to them and confirm that you have taken note of the Risk notice.
3.6 At present only private persons may sell on the Platform. If you act as a business, that is, in the exercise of a commercial or self-employed professional activity (Section 14 BGB), you may not list lots until we have told you on the Platform that business sellers are admitted. Hammerprice's own house shows are the exception (section 17.3).
4. Free use and user agreement
4.1 By using the Platform, a free user agreement is concluded between you and us. Fees are charged only to sellers under section 9.
4.2 We owe provision of the Platform within what is technically possible, but no particular result, no constant availability and no particular number of rooms or lots.
4.3 Profile: On your profile page you may, voluntarily, set a username, a display name, a short text and a picture (Privacy Policy, section 3.14). The rules of sections 12 and 13 apply to them: we may reject or remove a name, a text or a picture that breaks them or poses as the Platform, and block an abused profile.
4.4 Telegram: Telegram messages are a voluntary extra. You connect the bot @hammerpricebot yourself from your profile, choose which messages you receive (for example when you are outbid or win, or with /watch for the next lots of a room) and can disconnect at any time (/stop). A link in a message may open a room with the amount pre-filled. The bot never bids for you, signs nothing and holds no key: you confirm every bid yourself and sign with your own wallet. We do not owe timely or complete delivery of a message; what your profile and the room show is what counts. For privacy see section 3.11 of the Privacy Policy.
4.5 Waiting list: The waiting list is voluntary. You enter only your email address, and we use it only to tell you once that Hammerprice is reachable on the main network (section 3.13 of the Privacy Policy). It gives you no claim to access, to a launch date or to a launch on the main network.
5. Bids
5.1 A bid is a declaration signed by you with your wallet by which you bindingly offer the seller to buy the called lot at the stated price in USDC. A bid is not a blockchain transaction, transfers nothing and costs nothing.
5.2 The button with which you place a bid is labelled "Place binding bid, payment due if you win". It leads to a confirmation step that shows the lot, your price and the expected fees. The bid is placed only when you confirm there. You can change your entries until then.
5.3 A bid is valid if (a) the signature is correct and covers this room, lot, amount and time, (b) the lot is open, (c) the bid meets the minimum increment above the highest bid, (d) you are not blocked, (e) you have registered a paddle for this room and (f) at the moment of the bid your wallet holds at least the bid amount in USDC, counting your other leading bids and sales still to be settled ("funded paddle"). We read your balance from the blockchain. If we cannot read it, the bid is refused. Your USDC stay in your wallet. We neither reserve nor lock them, so you could move them after a bid. If you then cannot pay, section 8 applies.
5.4 A bid lapses when a higher bid is placed or the lot ends without a hammer, for example because the reserve price was not met.
5.5 You cannot withdraw a bid once placed. Your statutory rights, in particular to rescind for mistake under Sections 119 ff. BGB and to withdraw under section 6.6, remain unaffected.
5.6 A room extends a lot if a valid bid arrives shortly before it closes. By default a bid in the last 15 seconds moves the closing time to 15 seconds after the bid, by at most 120 seconds in total per lot. Each room displays the rules that apply to it.
5.7 The seller may set a reserve price. The seller need not sell the lot below that price. If the highest valid bid is below the reserve, the lot closes without a sale.
5.8 Bids are visible to all participants in the room under the bidder's paddle number. The signed bids of a closed lot can be viewed and checked by anyone. They contain the bidder's wallet address.
5.9 The seller can withdraw a lot only before the first valid bid.
5.10 To bid in a room you register a paddle by signing a message with your wallet. The paddle number is shown in the room instead of your wallet address. The message may authorise a temporary key that your browser creates for this room and keeps in session storage, so that bids can be signed without a wallet popup. The maximum amount and the validity of that authorisation are part of what you sign. You can also bid with a wallet signature for every bid.
6. Hammer and conclusion of contract
6.1 By placing a lot in a room, the seller declares bindingly that they sell the lot to the bidder who, when the lot closes, has placed the highest valid bid, provided it meets the reserve price. Acceptance of the bid is thereby declared in advance. The seller no longer decides at the moment the lot closes, and cannot withdraw the lot after the first valid bid.
6.2 The "hammer" is the moment at which the closing time of the lot passes and the system determines the highest valid bid. Nobody decides at that moment. With the hammer, a sales contract for the lot is concluded between the seller and the highest-bidding buyer, at the price of the highest bid. We transmit the parties' declarations as a messenger.
6.3 We store the lot, the bids, the hammer and the rules applicable at the time. You can view this information via your wallet address or request it from us. The settlement transaction carries a short note with a fingerprint (hash) of the signed bid history, so that anyone can check afterwards that the recorded bids are the ones the result was based on. You can open and save these terms here at any time.
6.4 The sales contract is governed by German law. The rules on consumer contracts apply only if the seller is a business and the buyer a consumer. At present no business sellers are admitted (section 3.6).
6.5 The seller owes transfer of the token free of third-party rights and in the condition described; the buyer owes payment of the hammer price in USDC.
6.6 Right of withdrawal: if a seller who acts as a business sells to a consumer, the buyer may have a statutory right of withdrawal. In online auctions, the exception for publicly accessible auctions under Section 312g(2) no. 10 BGB generally does not apply, because it requires that consumers are personally present or can be present. Details and templates are under Consumer information. A business seller is obliged to instruct the buyer properly.
7. Settlement
7.1 After the hammer, the sale is settled in one blockchain transaction: the USDC go from the buyer to the seller, the fee to our fee address and any creator royalty to its recipient, and the token from the seller to the buyer. Either everything happens or nothing. There is no partial execution.
7.2 The transaction needs the signatures of the buyer and of the seller. Each of you signs the same transaction with your own wallet, in any order. The buyer's signature releases only the buyer's USDC, the seller's signature only the seller's token, and the transaction does nothing unless both are present. Neither key can move the card or the money alone. Before you sign, the Platform shows you the legs of the transaction and checks them against the agreed amounts.
7.3 Our server adds one further signature, that of our settlement authority, and sends the signed transaction to the network. That signature pays the network fees and account rent. It has no authority over any asset of the buyer or the seller and cannot move a card or money. We hold no key that can.
7.4 Each attempt is a signing round of about one minute. If both signatures are not present by the end of a round, the stored signatures are discarded and a new round can be started. Both parties must sign within the settlement window after the hammer. It is 15 minutes by default, and the Platform shows it for every sale. The buyer must hold enough USDC. The seller must be online during the window and may not transfer, freeze, encumber, redeem from the vault or destroy the lot until settlement.
7.5 When the transaction is confirmed on the blockchain, possession of and risk in the token pass to the buyer. Both parties can see the status in the Platform and in any blockchain explorer.
7.6 If the transaction fails for technical reasons (for example network outage, error in a third-party program), nothing is transferred and the parties can try again within the window. If the window ends without a confirmed transaction, the settlement expires. The card and the money have not moved, the lot is shown as "not completed", and section 8 applies to the party who did not act. You have no claim to a new listing.
7.7 The physical card stays in the third party's vault. Whoever holds the token may have it redeemed under the vault operator's terms, which may incur costs and may destroy the token. We are not responsible for this.
8. Non-performance and measures against unreliable users
8.1 Bids and the sales contract under section 6 are binding. If a buyer does not perform, the seller may exercise their statutory rights (in particular performance, setting a deadline, withdrawal and damages, Sections 280, 281, 323 BGB). That is a matter between buyer and seller. We collect nothing for the seller and pay no damages.
8.2 If a settlement is not completed because of you, we record a strike against you. That is the case if, as a buyer, you did not sign within the window or did not hold enough USDC, or if, as a seller, you did not sign, moved, froze or encumbered the lot, or were not reachable. The strike is recorded automatically. After the twentieth strike your paddle is suspended and your wallet is blocked. You can ask us to review any strike: write to info@futurewebservice.de and a person will look at it.
8.3 Besides that, we may take the following measures for rule violations: warning, limiting bid amounts, temporary or permanent blocking. These measures are neither a contractual penalty nor liquidated damages. They protect other users and the integrity of the Platform. We take into account frequency, severity and circumstances.
9. Fees
9.1 Buyers pay us no fee. Sellers pay a brokerage fee of 2.5% of the hammer price, only if a lot sells. The fee is routed to us in the same transaction. The seller receives the rest. For a pack (section 22) the fee is the same percentage of the pack price, deducted in the same payment, and the buyer pays no fee on top of the price. In a chance pack the buyer pays the operator directly and the fee is a separate part of the same payment. AI credits (section 20) are paid separately and are the only thing a buyer or seller pays us directly.
9.2 Fees of third parties may arise in addition, such as blockchain network fees, creator royalties and fees of the vault operator. They do not go to us. The Fees page says who pays the network fees and lists the other fees where known to us.
9.3 We are a small business within the meaning of Section 19 UStG (German VAT Act) unless the legal notice states otherwise. No VAT is then shown.
9.4 We notify fee changes at least 30 days before they take effect, in text form or by notice on the Platform. They do not apply to lots already running in a room when they take effect.
10. Seller duties
10.1 You may only list lots that belong to you and that you are free to dispose of.
10.2 The description must be true, complete and not misleading, in particular as to authenticity, condition and grading of the card. You vouch that the token corresponds to the described card in the vault.
10.3 You may not bid on your own lots, yourself or through other persons or wallets (shill bidding), and may not make arrangements to manipulate prices.
10.4 You indemnify us against claims of third parties based on your unlawful statements or lots, to the extent you are responsible for the infringement.
11. Bidder and buyer duties
11.1 Bid only if you want and are able to buy. A bid is meant seriously.
11.2 You may not use scripts, bots or other means to disrupt the auction or obtain unfair advantages. You may not agree with other bidders to influence prices.
11.3 You are yourself responsible for your taxes and reporting duties.
12. Prohibited goods and conduct
Not allowed are:
(a) counterfeit, imitated or stolen cards or tokens, tokens without backing in the vault;
(b) goods whose offering or trade violates the law, in particular goods that infringe third-party rights;
(c) games of chance or random-draw formats outside the pack function of the Platform (section 22), other than the thank-you draw under section 2.4, in particular raffles, random packs and similar offers that do not use that function's committed pool and published odds;
(d) shill bidding, price agreements, wash trading and other market manipulation;
(e) insults, threats, publication of others' private data, and incitement to hatred or other illegal content;
(f) attempts to disrupt or overload the Platform or to circumvent security measures, and circumventing the fee;
(g) money laundering, terrorist financing and use of the Platform for sanctions violations;
(h) selling as a business without our consent (section 3.6).
13. Content rules, moderation and notice procedure (Digital Services Act)
13.1 Restrictions: users may post content (lot descriptions, images, names, messages in the room) only within the limits of section 12. Illegal content is prohibited.
13.2 Measures: we may remove or block content, take lots out of a room, warn users, block them temporarily or permanently and end the relationship. We decide after a diligent, objective and proportionate assessment and take the rights of all parties into account, including freedom of expression.
13.3 Tools: we use automatic rules that check signatures, rate limits and multiple bids. They follow fixed criteria and create no user profiles. Chat messages are checked against fixed rules and then approved or rejected by the room operator (section 19). Decisions about content and blocking are made by a person.
13.4 Notices: anyone can report illegal content to us via Contact and reports. We confirm receipt, review promptly and communicate the decision.
13.5 Statement of reasons: if we restrict content or block a user, the affected person receives a statement of reasons with the facts, the legal basis or contract rule, whether automated means were involved, and the options for redress.
13.6 Complaint: you can complain about our decision to info@futurewebservice.de. A person reviews it within a reasonable period. Statutory rights, in particular recourse to the courts and a complaint to the Digital Services Coordinator in Germany (Bundesnetzagentur), remain unaffected.
14. Rights in content
14.1 You keep the rights in your content. You grant us a simple, non-exclusive, worldwide licence, for the duration of use, to store, display and technically process your content on the Platform to the extent necessary for operation.
14.2 You warrant that you are entitled to do so and do not infringe third-party rights.
14.3 Card images and metadata come from public token data. Trademarks and images belong to their respective rights holders. Report infringements via Contact and reports.
15. Blockchain, wallet and third-party risks
15.1 You use Hammerprice at your own risk within the limits of these terms. The main risks are in the Risk notice. They include errors in programs and wallets, phishing and loss of keys, irreversible transactions, price fluctuations, failure or freezing of stablecoins, failure of the vault operator and changes in law.
15.2 Blockchain transactions are final. We cannot reverse them.
15.3 Services of third parties (wallets, RPC providers, the Solana network, the programs used for USDC and cards, the vault operator, Circle) are subject to their own terms.
16. Liability
16.1 We are liable without limit for intent and gross negligence, for injury to life, body or health, under the Product Liability Act, for fraudulently concealed defects and when we have given a guarantee.
16.2 For slight negligence we are liable only for breach of an essential contractual duty, that is, a duty whose fulfilment makes proper performance of the user agreement possible in the first place and on whose observance you may regularly rely. Liability is then limited to the foreseeable damage typical for this kind of contract.
16.3 Otherwise our liability is excluded. In particular we are not liable for the conduct of other users, for services of third parties, for failure of the blockchain and for price fluctuations, to the extent that we are not responsible for them.
16.4 The limitations of liability also apply in favour of our employees and vicarious agents.
17. Availability, changes, demonstration mode
17.1 We may change, extend or restrict the Platform at any time where reasonable for you, in particular for maintenance, security or legal reasons.
17.2 If the Platform runs in demonstration mode (test network, see the notice at the start of these terms), tokens and balances have no value and no real exchange of assets takes place. Demonstration mode serves solely to showcase the features. Nothing is owed outside the test network.
17.3 In demonstration mode we run "house shows". The lots of a house show are replicas that we created and own, and the seller is our own house account. So that a visitor can win a lot with one wallet signature, our server signs the house seller's part of the settlement automatically. That is not custody: the assets are our own test assets and are labelled as such. A buyer's assets are moved only by the buyer's own signature.
17.4 Hammerprice currently runs as a live beta and has so far not been operated on the main network with real money. A launch on the main network is planned after the hackathon but is not promised. Should it happen, we would announce it on the Platform and adjust these terms where necessary under section 25.
18. Timed auctions
18.1 A timed auction is a show with exactly one lot that stays open for a fixed period between 10 minutes and 14 days. The rules of sections 5 to 8 apply, with the differences in this section. For now only Hammerprice itself offers timed auctions, as labelled demo rooms.
18.2 The lot closes by itself at its end time. The end time counts, not the moment at which the Platform first processes the close: the settlement window starts at the end time, and a late reader does not shorten it.
18.3 A bid shortly before the end extends the end (soft close). By default a bid in the last 5 minutes moves the end to 5 minutes after the bid, by at most 24 hours in total. Each auction shows the rules that apply to it.
18.4 The settlement window of a timed auction is 3 days after the end time; for Hammerprice's own timed demo lots in demonstration mode it is 6 hours. The Platform shows it on every lot. The seller cannot change it.
18.5 Your USDC are checked when you bid and again when you pay. They are not reserved (section 5.3). Keep enough in your wallet until the end.
19. Room chat
19.1 A room may have a chat. It is moderated in advance: what you write is not public until the room operator has approved it. You see your own waiting message marked as waiting for approval.
19.2 The room operator is the seller of the show and, for house shows, the operator of the platform. The operator decides which messages are published, can reject a message with a reason, can mute you for a time and can block you for the show. The operator is responsible for the messages they publish.
19.3 Not allowed in the chat: links, email addresses, phone numbers, handles and wallet addresses, advertising, insults and unlawful content (section 12). The Platform refuses such messages automatically. These rules are not understanding, which is why a person reads every message before it is published. Bots do not post.
19.4 You can report a public message with the report button, and anyone can report via Contact and reports. The chat has no effect on bids, hammers or settlements.
19.5 Messages are deleted on the schedule in the Privacy Policy, section 3.8.
20. AI functions
20.1 The Platform offers an AI draft for the title and description of a lot, an assistant that picks the matching answer from our FAQ, and an AI agent on the "AI" page (section 20.5). All use an AI model of Google (see the Privacy Policy, section 3.9). Every AI function needs a signed-in wallet. They are optional and may be switched off. If the AI service is not available, you get a plain template instead, labelled as a template, at no cost.
20.2 AI drafts and assistant answers can be wrong. As a seller you review every text you adopt and you are responsible for your description (section 10). Adopted AI text is labelled in the room as "AI-assisted, reviewed by the seller". The assistant gives no legal, tax or investment advice.
20.3 A draft costs one credit, and 1 USDC buys 10 credits. During the judging period credits can be switched off: AI is then free, no credit is needed and none is debited. You pay in one transaction that you sign, directly to our fee address. A credit is a counter, not money and not stored value. Credits are not transferable. If a draft fails, the credit is returned. If a purchase was not credited, write to info@futurewebservice.de. The AI agent never uses a credit.
20.4 The AI functions are for people aged 18 or over. Do not enter personal data into notes or questions.
20.5 The AI agent searches lots, prepares a bid proposal and drafts a listing. It does not place a bid, signs nothing and changes nothing: you place a bid yourself in the room with your wallet, and you take over a draft yourself with the button. An amount it prepares is not above the one you named. Its suggestions can still be wrong (section 20.2); check the lot, the price and the amount before you confirm.
21. Live video
21.1 A seller may switch on live video for a show. It is off unless the seller does it. Viewers load it only by pressing "Load live video" (see the Privacy Policy, section 3.10).
21.2 The picture is a courtesy. It can be delayed, poor or missing, and you have no claim to it. Bids and the end of a lot follow the clock of our server, not the picture.
21.3 We decide which accounts may send. Whoever sends shows only the card and no people without their consent, and no unlawful content (section 12). We store no recording.
22. Packs
22.1 A pack is a sealed draw from a pool of real cards that a pack operator owns. There are two kinds. In a chance pack the cards differ in rarity and in listed value; in an equal-value pack every card has the same listed value. Both are offered by independent pack operators, who are the sellers. Hammerprice provides the technology and the verification, is not the seller and does not receive the price. In demonstration mode Hammerprice itself operates one demo chance pack with replica cards without value and test USDC; it is marked as a demo and exists on the test network only.
22.2 Before you buy, the Platform shows the price, the operator, the odds per rarity and the full pool. They are fixed by a hash before the first sale, and the operator cannot change the pool after sales start. If a rarity is sold out, its share is spread over the others in proportion. The listed value of a card is the operator's own figure and not a promise of a price.
22.3 Which card you get is decided by a random draw (ECVRF) with a public proof. In a chance pack the draw is made only after your payment is final on the blockchain: no card is chosen or shown before that, and the input of the draw contains the signature of your payment and a block that was produced after it, so neither you nor we can steer it. In an equal-value pack the card is drawn when you start the purchase. On the proof page anyone can recompute the draw from the pool, your seed and the beacon. You do not know in advance which card you will get.
22.4 Chance pack: you pay first, and you pay the pack operator directly. Your USDC go to the operator's wallet, with the fee under section 9 as a separate part of the same payment, in a transaction that you sign and for which our settlement authority only pays the network fees. We never receive the price. After your payment is final, the card is drawn. The operator must then deliver it to your wallet in a second transaction that the operator signs, within the delivery deadline (24 hours after the draw unless set otherwise); our settlement authority again only pays the network fees. Because we hold no money, we cannot refund you. If the operator does not deliver in time, or moves the drawn card away, the sale is marked as not delivered, the operator receives a strike (section 8) and the pack is paused, and no second draw is made. The pack page then shows you the operator's wallet, the signature of your payment and the proof of the draw, so that you can claim against the operator yourself. A card that the operator still delivers late reaches your wallet. The delivery record of the operator (delivered, late and not delivered sales and the median delivery time) is public and is shown before you pay, together with a notice of this risk. The state of your purchase (pay, confirming, drawing, waiting for the operator, delivered or not delivered) is shown on the pack page. If you do not complete the payment within the time shown, nothing is charged. Equal-value pack: you pay in the same kind of single transaction as in section 7: your USDC go to the operator, less the fee under section 9, and the card moves from the operator's wallet to yours. You and the operator both sign. Hammerprice holds neither your money nor the cards. If the signing round runs out before everything is signed, nothing is charged and you can try again.
22.5 You must be 18 or older and you confirm it before every purchase. There is a daily limit per wallet, set per pack (5 unless the pack says otherwise). There is no balance and no credit: nothing is stored for later, and a purchase is a payment to the operator and a card, nothing else. The daily limit counts a purchase from the moment you start it and gives it back when the purchase is never paid or fails. A pack operator cannot buy their own pack.
22.6 A pack operator may offer only cards that they own and may dispose of, must describe them truthfully (section 10) and may not change the pool after sales start. An operator who does not deliver in time gets a strike, and after the twentieth strike is suspended (section 8). We may pause or close packs and switch the pack function off (section 17.1).
22.7 The card is yours when the transaction that moves it to you is confirmed on the blockchain (in a chance pack the delivery, in an equal-value pack the single transaction). Section 15 and the Risk notice apply, including that transactions are final.
23. Term, termination, blocking
23.1 You can stop using the Platform at any time by disconnecting your wallet. Running sales contracts remain in place and must be performed. For deletion of your data the Privacy Policy applies.
23.2 We may terminate the user agreement with 14 days' notice in text form. The right to extraordinary termination and to immediate blocking for good cause remains unaffected, for example in the case of legal violations, danger to security or repeated breaches of these terms.
24. Ranking
24.1 Rooms are listed in three groups: running rooms first, then announced rooms (soonest first), then ended rooms (most recent first). Lots within a room open in the order of their lot numbers, which the seller sets. There is no paid placement and no preference for our own house shows beyond this order.
24.2 You can view your own lots, bids and settlement data via your wallet address and request them from us in machine-readable form.
25. Changes to these terms
25.1 We may change these terms with effect for the future where this is necessary for good reason, such as a change in law, changes to the service or abuse prevention, and the change is reasonable for you.
25.2 We announce changes at least 30 days before they take effect, by notice on the Platform and, where we have contact details, in text form. A change applies to you only if you agree to it. We ask for your agreement, for example when you next sign in. If you do not agree, the earlier terms continue to apply until we terminate the user agreement under section 23.2. Running sales contracts remain unaffected.
26. Governing law, jurisdiction
26.1 German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. For consumers habitually resident in another EU Member State, mandatory consumer protection rules of that state remain unaffected.
26.2 If the user is a merchant, a legal entity under public law or a special fund under public law, the place of jurisdiction is Hoyerswerda. For consumers the statutory places of jurisdiction apply.
27. Consumer dispute resolution
We are neither willing nor obliged to take part in dispute resolution proceedings before a consumer arbitration board.
If no agreement is reached after a complaint, we refer consumers in text form to a competent consumer arbitration board (Section 37 VSBG). A generally competent body is the Universalschlichtungsstelle des Bundes, Zentrum für Schlichtung e.V., Straßburger Straße 8, 77694 Kehl am Rhein, Germany, www.universalschlichtungsstelle.de.
The European Online Dispute Resolution platform (ODR platform) was discontinued on 20 July 2025. A reference to it is no longer required.
28. Final provisions
28.1 If individual provisions are invalid, the others remain valid. The statutory rule replaces the invalid provision.
