Contact and reports

This page explains how to reach us, how to report illegal content and how we deal with it. It is based on Regulation (EU) 2022/2065 (Digital Services Act, DSA).

We do not reply solely by automated means. A person reads your message. We aim to reply within two working days and in any case confirm receipt.

Reporting illegal content (Art. 16 DSA)

Any person or entity can report to us content they consider illegal. This includes, for example, lot descriptions, images, names, messages in the room and profile details (username, display name, short text, profile picture), as well as counterfeit or stolen cards and infringements of copyright and trademarks.

Write to info@futurewebservice.de. Please state:

  1. Reasons: why do you consider the content illegal? Give facts and, if you can, the provision violated.
  2. Location: the exact address (URL) of the content, for example the address of the room or lot, and, where needed, further details that identify it.
  3. Your name and email address. Exception: for notices concerning offences under Arts. 3 to 7 of Directive 2011/93/EU (child sexual abuse), name and email are not required.
  4. Statement: you confirm that your information is accurate and complete to the best of your knowledge.

Messages in the room chat are reviewed by the room operator before they are public. If a message is rejected, the author sees the reason in the room. Signed-in viewers can use the report button on a public message. Visitors without a session report through this page.

What happens next

  1. Confirmation of receipt. If you gave an email address, we confirm receipt without undue delay.
  2. Review. We review the notice promptly, diligently and objectively. A person makes the decision. We do not use automated decision-making for this. If we ever use automatic aids, we will say so in the notice of the decision.
  3. Decision. We may remove or block the content, leave it visible or ask for more information. For violations we can also warn or block users (see Terms, section 13).
  4. Notification. We tell you the decision without undue delay, including the options for redress.

If a notice is manifestly unfounded or abusively repeated, we may set it aside or limit future notices after warning you.

Note: if we have indications of a criminal offence threatening the life or safety of persons, we inform the competent authorities (Art. 18 DSA).

If we restrict your content (Art. 17 DSA)

If we remove or block your content, restrict its visibility or block your wallet, you receive a clear statement of reasons with:

  • the kind of measure and its duration,
  • the facts and circumstances we rely on,
  • whether the decision is based on a notice and, where strictly necessary, who reported,
  • the legal basis or the contract rule,
  • whether automated means were involved,
  • the options to complain, to turn to the authority and to go to court.

Complaint against our decision

You can write to us at info@futurewebservice.de at any time if you disagree with a decision. We then review the matter again, with human review, and reply with reasons. As a micro enterprise we are exempt from the formal duty to run an internal complaint-handling system and to take part in out-of-court dispute settlement bodies under Arts. 20 and 21 DSA (Art. 19 DSA). We still keep the procedure as simple and fair as possible. Your rights, in particular access to the courts, remain unaffected.

Information about sellers

At present only private persons sell on the platform, and Hammerprice itself in its house shows and house packs (Terms, section 3.6). A pack operator is a seller in this sense. If business sellers are admitted later, we will show for each lot their name, address, contact details, any register number and their declaration to offer only goods that comply with applicable law, and we will ask for this information before they can list lots.

Authorities

  • Requests from authorities of the Member States, the European Commission and the European Board for Digital Services go to info@futurewebservice.de. We reply in German or English.
  • Orders to act against illegal content and to provide information (Arts. 9 and 10 DSA) also reach us there.
  • In Germany, complaints from users about infringements of the DSA are received by the Digital Services Coordinator at the Bundesnetzagentur (www.dsc.bund.de). Please contact us first where illegal content is concerned.

Transparency

We are a micro enterprise and our number of monthly active recipients in the European Union is far below the 45 million threshold. On request of an authority we provide the figure (Art. 24(3) DSA).
