Consumer information and withdrawal

This page explains to you as a buyer who your contracting party is, how contracts are formed, what rights you have and how lots are sorted. It supplements the Terms.
1. Who is my contracting party?
You conclude the sales contract for a lot with the seller, not with Hammerprice. Future Webservice only provides the platform on which you bid and the contract is formed, and relays the declarations. We are neither the seller nor the seller's agent and do not become a party to your purchase.
Who sells at present: only private persons, and Hammerprice itself in its house shows and house packs on the test network. Sellers who act as a business are not admitted yet (Terms, section 3.6). Two cases follow:
- Private person (not a business): the special rules for consumer contracts do not apply to this purchase. In particular you then have no statutory right of withdrawal. Warranty rights may be excluded within the legal limits.
- Business (once business sellers are admitted): name, address and contact details will be shown with the lot. Consumer protection rules, in particular on withdrawal and warranty, apply as provided by law, and sections 5 and 6 below apply in full.
Hammerprice and the seller are not affiliated. We also do not perform the seller's obligations under the sales contract. You therefore have no contractual claims of your own against us arising from the sales contract.
2. How are rooms and lots sorted?
- Rooms are listed in three groups: running rooms first, then announced rooms, then ended rooms. Announced rooms appear soonest first, ended rooms most recent first.
- Lots in a room open one after another in the order of their lot numbers, which the seller sets.
- There is no paid placement. We offer nothing ourselves except our house shows and house packs, which are sorted like every other room.
3. How is the contract formed?
- You choose a lot in a room and check the description and the price.
- You place a bid. The button is labelled "Place binding bid, payment due if you win". It leads to a confirmation step that shows the lot, your price and the expected fees. The bid is placed only when you confirm there.
- When the closing time of the lot passes, the system closes the lot by itself. If your bid is then the highest valid one and meets the reserve price, the sales contract is formed (Terms, section 6). You see the result immediately. Nobody decides at that moment.
- You pay and receive the token in one blockchain transaction that you and the seller sign with your wallets.
You can correct input errors at any time before you confirm. After that, a bid is binding. Statutory rights, for example to rescind for mistake, remain unaffected.
Contract text: we store the lot, the signed bids, the closing and the rules that applied. You can retrieve this information via your wallet address or request it from us. The signed bids of a closed lot can also be checked by anyone. Contract languages: German and English.
4. Prices, payment and delivery
- All prices are stated in USDC. There is no other payment method.
- Buyers pay no fees to us. You pay the hammer price. The settlement authority pays the network fee. See Fees.
- Delivery: what you buy is a token on the Solana blockchain. It is transferred to your wallet in the same transaction in which you pay. There are no shipping costs for the token. The physical card stays in a third party's vault. Whoever holds the token can have it redeemed under that party's terms, which may incur shipping, redemption and other costs. On the test network there is no physical card.
- Time for payment: you must sign the transaction within the settlement window stated in the Terms (section 7.4).
5. Right of withdrawal
When does it apply?
This section matters once business sellers are admitted. At present no business sells on the platform.
If a business sold you the lot through the platform and you are a consumer, you may have a statutory 14-day right of withdrawal for this distance contract (Sections 312g, 355 BGB).
According to the wording of the statute, the exception for "publicly accessible auctions" (Section 312g(2) no. 10 BGB) covers only auctions in which consumers are personally present or can be present. That is generally not the case in pure online auctions. We therefore assume, as a precaution, that consumers can withdraw from purchases from businesses.
For a purchase from a private person there is no statutory right of withdrawal.
Whether and how the right of withdrawal exists in an individual case also depends on whether the contract is to be regarded as a sale of goods or a supply of digital content, and on whether exceptions or early expiry apply (Section 356 BGB). The seller decides that in their withdrawal instructions. You find them with the lot.
Who gives the instructions?
The seller, not us. Business sellers must instruct you about your right of withdrawal using the statutory templates (Annex 1 to Art. 246a Section 1(2) sentence 2 EGBGB) and give you the model withdrawal form. If the instructions are missing, the withdrawal period is extended (Section 356(3), (4) BGB).
How do I withdraw?
Declare the withdrawal to the seller, clearly, for example by email to the address given with the lot. You can use the following form, but you do not have to.

6. Defects and warranty
- Business as seller: the statutory warranty rights apply. They cannot be excluded to your disadvantage.
- Private person as seller: warranty rights may be excluded or limited within the legally permitted scope. In case of fraud, guarantees and injury to life, body and health this is never possible.
- Card condition, authenticity and grading are statements of the seller and of third parties. We do not verify them.
7. Questions, complaints and disputes
